Title 14 of the Code of Federal Regulations (14 CFR) Part 107 (PLT448) classify any drone operations (flying / taking photos / videos) relating to a business or receiving any form of compensation as "commercial", thus requiring the drone pilot to be licensed.
The civil penalties for flying a commercial drone operation without obtaining a remote pilots license from the FAA are up to $32,666 for each incidence. The fine is charged per day for continual illegal use of a drone for commercial purposes. The FAA may also impose criminal sanctions, which include a fine up to $250,000 and/or a prison sentence up to three years upon conviction.
